1. Acceptance of Terms
By accessing or using DubbyJam (the "Service"), operated by Cheng Lu (Trading as DubbyJam), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Description of Service
DubbyJam is a web-based SaaS platform for AI dubbing and translation. You can upload audio or supported video, generate translated speech cues, and export dubbed audio or a video with replaced audio. We may offer free usage and paid plans.
The Service provides neutral technical tools only. We do not pre-screen user uploads, translations, or exports, and we do not endorse, warrant, or recommend the legality, accuracy, or fitness of any content.
3. Payments and Billing
Our order process is conducted by our online reseller Dodo Payments. Dodo Payments is the Merchant of Record for all our orders and provides customer service inquiries and handles returns.
By purchasing a paid plan, you agree to pay the fee shown at checkout. Whether billing is one-time or recurring is shown on the checkout page and order confirmation.
4. Refund Policy
Paid purchases may be eligible for a time-limited refund. See our Refund Policy.
5. Intellectual Property
The software, interface, branding, and related technology of the Service are owned by DubbyJam or its licensors. You may not copy, modify, reverse engineer, or use them to build a competing product without written permission.
You retain rights in content you upload and dubbed outputs you create, to the extent you hold those rights under law. You grant us a non-exclusive, worldwide, sublicensable license to host, process, transmit, display, and back up that content as needed to operate the Service, including sharing data with speech, translation, and TTS providers. This license ends when you delete the project or we delete data as required by law, except where retention is legally required.
6. Your Content and Copyright Responsibility
You are solely responsible for all content you upload, process, generate, download, publish, or otherwise use through the Service, including:
- confirming that you own, or have obtained valid and sufficient authorization (including sublicensing where needed) for all copyrights, neighboring rights, trademarks, publicity/privacy rights, voice rights, and other interests involved;
- confirming that your use (including translation, dubbing, remixing, redistribution, and commercial use) does not infringe any third-party rights;
- bearing all disputes, claims, penalties, and losses arising from the source of your content, defects in your rights, or how you use outputs.
You understand that DubbyJam is a technology provider, not a publisher, distributor, or agent of user content. Users decide what to upload and how to use exports. We are not jointly or severally liable for users' infringing or unlawful use of the Service.
You must not use the Service to (including but not limited to):
- upload, translate, dub, or distribute copyrighted films, game footage, music, podcasts, courses, livestream clips, or other protected works without authorization;
- clone another person's voice, impersonate others, or create deepfakes likely to mislead the public without authorization;
- infringe copyright, trademark, publicity, privacy, or other rights;
- create or distribute fraudulent, defamatory, harassing, obscene, violent, or otherwise unlawful content;
- circumvent technical protection measures or assist others in doing any of the above.
7. Copyright Complaints and Repeat Infringers
If you believe content on the Service infringes your rights, send a written notice to jam@dubbyjam.com including, where possible: proof of identity, proof of rights, sufficient information to locate the material (e.g. account or project), your contact details, and a statement that you have a good-faith belief the use is not authorized.
Upon receiving a compliant notice, we may remove or restrict access to content and suspend or terminate accounts as permitted by law. We are not responsible for verifying notices beyond what the law requires.
We may restrict or permanently terminate accounts we determine to be repeat infringers, with or without further notice.
8. Indemnification
You will defend, indemnify, and hold harmless DubbyJam, its affiliates, and their officers, employees, contractors, and partners from any claims, investigations, suits, penalties, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your content, your representations, or allegations of copyright, trademark, publicity, privacy, defamation, or unfair competition related to your use of the Service.
9. Project Retention and Auto-Deletion
To manage storage, projects and their associated cloud files are deleted automatically based on the last time you opened the project page (not every edit).
Free accounts: deleted 30 days after last open. Paid benefits (active subscription or top-up balance): deleted 90 days after last open.
Deleted projects and object-storage files are not recoverable. We show an expiry warning on the project list about 7 days before deletion. Opening a project resets the retention clock. Storage caps are described in-product and on /limits.
10. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:
- the legality, accuracy, or infringement risk of user content;
- how users publish or commercialize exported outputs;
- any direct, indirect, incidental, special, punitive, or consequential damages (including lost profits, goodwill, data, or business interruption) arising from user content or user conduct;
- outages or failures of third-party services (payments, sign-in, AI processing, etc.).
Except where liability cannot be excluded by law, we are not liable for users' or third parties' infringement as a joint, several, or contributory matter. If we are nonetheless found liable, our total liability is capped at the fees you paid us in the twelve (12) months before the event giving rise to the claim, or USD 15 if you only used free features.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.
